The argument between Jacques Maritain and Charles de Koninck over the primacy of the common good is well known. Yet, even though Mary Keys has carefully arbitrated this debate, it still remains problematic for Alasdair MacIntyre, particularly because of the role rights play in both Maritain and Catholic Social Thought. I examine Keys’ argument and, in addition, Deborah Wallace’s account of MacIntyre’s criticism of rights in Catholic social thought. I argue, in the end, that what Maritain, and in consequence Keys (...) and Wallace, miss about the common good is its relationship to practical reasoning, and that MacIntyre highlights both that relationship and the role of the common good in human dignity. Caritas in Veritate leaves us with a question, Does Benedict XVI see politics as a practice or as an institution? How one answers this question has tremendous implications for how one should address the inequalities of contemporary society and the increasing globalization of the world. Alasdair MacIntyre, for instance, would consider politics to be primarily a practice with a good internal to its activities. This good consists in rational deliberation with others about the common good. If one considers politics an (...) institution, however, as seems to be the case with Jacques Maritain, then one pays less attention to the common good and more attention to the mechanics of the political institution. The difference in understanding goes a long way toward how one conceives of, determines, and achieves the common good, a central task for Catholic social teaching. It also prefigures whether and how one can justify self-sacrifice for the common good, demanded of police officers and soldiers, for instance, as well as whether and how one prioritizes the practices of a given political community. Caritas in Veritate (CIV) brings to the forefront issues of self-sacrifice and prioritization of practices at the global level. This paper shall address the position Benedict XVI lays out on globalization with reference to a global politics through the lens of the common good and the distinction between practice and institution. This work deconstructs the subjective experience, and identifies the role of empathy in experience as being capable of reconciling the mob mindedness that accompanies ideologies. The essence of the paper is to discuss and elucidate the societal impact of empathetic being, and the correlation with such states of being as an avenue for learning which identifies and interprets reality rather than realizing it. The idea is that by empathetically interpreting our experience and empathetically informing our modes of expression, one becomes (...) capable of interpreting universal archetypes. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands us (...) to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

In this paper we argue that dissociative identity disorder (DID) is best interpreted as a causal model of a (possible) post-traumatic psychological process, as a mechanical model of an abnormal psychological condition. From this perspective we examine and criticize the evidential status of DID, and we demonstrate that there is really no good reason to believe that anyone has ever suffered from DID so understood. This is so because the proponents of DID violate basic methodological principles of good causal modeling. (...) As formulated by atheist Jeffery Jay Lowder, the Evidential Argument from the History of Science, or AHS, is premised on the observation that over the course of modern history, naturalistic explanations have progressively overtaken supernaturalistic explanations. That history, says Lowder, constitutes evidence that metaphysical naturalism is true (hence that theism is false). But it’s possible that the historical pattern as described is not actually the result of any genuine explanatory virtues of naturalistic over supernaturalistic explanations. If there are good (...) reasons to suspect that naturalistic explanations fail to accurately or adequately explain the world around us, then we would not have sufficient grounds to follow Lowder’s argument to its conclusion. Here I will present three reasons to suspect that naturalistic explanations fail to accurately or adequately explain the world around us: (1) an alternative reading of the history of science according to pessimistic induction; (2) the arbitrary epistemic requirements of methodological naturalism; and (3) the ongoing resistance of certain phenomena (the origins of the universe and of life on earth) to any naturalistic explanations that are coherent and relatively simple. The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. Theoretical (...) considerations, aimed at establishing the pragmatic meaning of an utterance and differentiating between presumptive and non-presumptive interpretation, are thus interwoven with the practical legal need of distinguishing a correct indirect report from an indirect one or a misquotation. An incorrect report or a misquotation has the dialectical effect of attributing to the misquoted party commitments that he never held, which the latter needs to rebut. This shifting of the burden of persuasion can be increased by using strategically the conflict between the presumptive interpretation of an utterance and the non-presumptive one, i.e. the different types of pragmatic ambiguity. When an interpreter is confronted with an utterance taken out of its dialogical context, his interpretative process is not guided by the actual context or intention, but rather the most frequent or prototypical dialogical setting or the most typical individual purpose that it could have served to achieve. This presumptive reconstruction can be used to provide a prima facie case that the other party needs to reject. The stronger the interpretative presumptions a speaker needs to rebut, the more effective the misquotation strategy. The conflict between the systematic and the presumptive process of interpretation can be represented as an argumentative mechanism of reconstruction of the individual intention, which allows one to assess the reasonableness of the interpretative reasoning. Since the second half of the XXth century, researchers in cybernetics and AI, neural nets and connectionism, Artificial Life and new robotics have endeavoured to build different machines that could simulate functions of living organisms, such as adaptation and development, problem solving and learning. In this book these research programs are discussed, particularly as regard the epistemological issues of the behaviour modelling. One of the main novelty of this book consists of the fact that certain projects involving the building of (...) simulative machine models before the advent of cybernetics are been investigated for the first time, on the basis of little known, and sometimes completely forgotten or unpublished, texts and figures.
